Gaming law is the set of rules and regulations that apply to the gaming or gambling industry. Gaming law is not a branch of law in the traditional sense but rather is a collection of several areas of law that include criminal law, regulatory law, constitutional law, administrative law, company law, contract law, and in some jurisdictions, competition law. At common law, gambling requires consideration, chance and prize, legal terms that must be analyzed by gaming lawyers within the context of any gaming operation.^[1]

United States[edit]

In the United States, illegal gambling is a federal crime if it is done as a business.^[2] However, each of its states has its own laws regarding the regulation or prohibition of gambling.^[3] States that permit such gaming usually have a gaming control board established to oversee the regulation of the industry, such as licensing of those employed in the gaming industry. States that permit casinos and similar forms of gaming often have strict zoning regulations to keep such establishments away from schools and residential areas.

Ukraine[edit]

Parliament outlawed gambling in 2009 after a May 2009 fire in a gambling hall in Dnipropetrovsk that killed nine people. The Ukrainian parliament passed the law 'On Prohibition of Gambling Business in Ukraine' (Gambling Ban Law) banning gambling business and any participation in gambling in Ukraine on May 15. The President of Ukraine Viktor Yushchenko signed the law on June 23 and on June 25 it came into force. The Law On Prohibition of Gambling Business in Ukraine also applied to internet casinos, it did not apply to lotteries.Parliament legalised gambling again on 14 July 2020. Albeit with regulations and age restrictions (minimum age of 22).^[5]

It has the business of any game, context, lottery, or contrivance whereby a person risks. It has also the loss of anything of value in order to realize a profit. Some types of gambling are illegal in Louisiana the following:

Underage gambling

These kinds of gambling are illegal and it is unlawful for anyone under the age of 21 to play video poker devices or to gamble in a casino.

Gambling in Louisiana is also unlawful for anyone under the age of 18 to participate in the state lottery or in horse track betting. Violations result is in a fine of $500 and/or up-to six months imprisonment.

Gambling-related to dog fighting

La. R.S. 14:102.5 is making it illegal to own and possess. It is keeping or train a dog for the purpose of Gambling related dog fighting or to possess any paraphernalia used in training dogs to fight.

It is one of the violations for a first conviction results in a fine of up to $3000 and/or imprisonment of not more than three years.

Cockfighting and gambling related to cockfighting

La. R.S. 14:102.23 is making it unlawful for any person to organize or it is conducting any commercial or private cockfight where it is reasonably foreseeable that chickens would be injured. Gambling in Louisiana is also unlawful to possess, train or purchase.

It has any chicken for cockfighting purposes. A first offense conviction results are a fine of up to $1000 and/or six months imprisonment.

Computer gambling

Gambling in Louisiana by computer is one of the prohibited in Louisiana. Computer gambling in Louisiana is the conducting as a business of any game, context, lottery or other activity whereby a person risks.

It has the loss of anything of value in order to realize a profit when these are accessing the internet. A conviction results are in a fine of $500 and/or up-to six months imprisonment.
